Employer duties under Romania’s OUG 32/2026

Although this page is aimed at companies recruiting from Asia, coverage is not determined by continent. Each worker’s status should be assessed individually. The course is one important part of the employer’s wider responsibilities.

The program runs from each worker’s activity start date recorded in REGES-ONLINE for no less than six months.

This is not a program-wide average. The ordinance sets a weekly minimum that should be clearly scheduled and tracked.

Grammar alone is not enough: the program must include cultural and social integration elements for life in Romania.

Supporting documents for the employer duties must be kept for at least five years after employment ends.

Frequently asked questions about OUG 32/2026 courses

01Who must provide the courses?

Art. 7(1)(g) places the duty on the employer hiring foreign workers covered by the act. A provider supports delivery, but the company’s legal responsibility does not disappear.

02Does this apply to employees who already worked in Romania before 8 August 2026?

Do not assume one answer fits every file. OUG 32/2026 contains transitional rules, while Art. 7(1)(g) ties the program to the activity start date recorded in REGES-ONLINE. Review the start date, hiring procedure, residence status and any employer change for each worker.

03Which employees are covered?

OUG 32/2026 uses the definition of “foreigner” from OUG 194/2002, essentially covering people who are not Romanian, EU, EEA or Swiss citizens. Employers should check individual circumstances.

04When does the six-month period begin?

It begins on each person’s activity start date in Romania as recorded in REGES-ONLINE—not on the date of a general supplier agreement.

05How many hours are required each week?

Art. 7(1)(g) states at least six course hours per week for a minimum period of six months.

06What must the program contain?

Romanian language courses that also contain cultural and social integration elements. Grammar-only content does not reflect the complete statutory wording.

07Is an ANC certificate expressly required?

Art. 7(1)(g) does not state a general ANC-certificate requirement for every learner. It lists several delivery routes; provider status and appropriate documents should be checked for the specific situation.

08How long must supporting documents be kept?

Art. 7(1)(i) requires supporting documents for the employer duties to be kept for at least five years after employment ends.

09Does the course replace OSH instruction?

No. OSH instruction in a language the worker understands is a separate duty. Romanian learning can improve communication, but it does not replace it.
